Отдельные проблемные аспекты уголовно-правовой защиты интеллектуальной собственности

Abstract

The problems of criminal law protection of intellectual property in the Republic of Belarus are considered. The author believes that the purpose of the criminal law protection of relations in the field of intelectual property on the one hand must be the moral rights of authors and copyright holders, and on the other – the exclusive rights, so it is necessary to detail the criminal responsibility for an attack on the group of relations. Creating a common criminal law that would provide for liability for crimes against the turnover of civil rights (property benefits), but differ from the mechanism of appropriation of another's property (e.g. plunder) is required.
